NYC Local Law Compliance

On July 1, 2010 a number of New York City Local Laws (Local Law 84, 85, 87 and 88), aimed at promoting energy conservation in New York City, took effect. The Local Laws, which apply to buildings greater than 50,000 sq. ft., are a part of the City’s Greener, Greater Buildings Plan, under Mayor Bloomberg’s PlaNYC 2030. 

EME Group provides all services required by these Local Laws:

  • Local Law 84: Benchmarking - benchmarking of energy and water use commences May 1, 2011 and then by every year thereafter. Benchmarking requires the use of an EPA approved Benchmarking tool to measure the energy and water intensity of a building. As it appears in the records of the department of finance, benchmarking is required for the following buildings:
        - (i)  A building that exceeds 50,000 gross square feet
        - (ii) Two or more buildings on the same tax lot that together exceed               100,000 gross square feet, or
        - (iii) Two or more building held in the condominium form of                              ownership that are governed by the same board of
               managers and that together exceed 100,000 gross square feet.
  • Local Law 85: NYC Energy Conservation Code - went into effect on July 1, 2010, requires that any element of the building directly affected by additions, alternations and/or renovations must adhere to the New York City Energy Conservation Code (NYCECC). The NYC Department of Buildings will not issue building permits without documentation of compliance, including an energy analysis by a registered professional.

  • Local Law 87: Energy Audits & Retro-Commissioning – commencing in 2013 determined by the building’s tax block number, and every 10-years thereafter requires owners of buildings meeting the Benchmark criteria above to perform the following:
        - (i) Conduct a Level II ASHRAE Energy Audit of the base-building
               systems, which can provide a professional stamp as to the                        completeness of the analysis. This work must be overseen by                  either a NYS Licensed Professional Engineer or NYS
               Registered Architect
        - (ii) Perform Retro-commissioning on  the base-building systems
        - (iii) Submit to the building department, a professional stamped                    report by a NYS Licensed Engineer or NYS Licensed Architect                  documenting both the Energy Audit and the
               Retro-Commissioning.
  • Local Law 88: Lighting Retrofits and Submetering – requires building owners to upgrade their entire building’s lighting systems to meet current code by January 1, 2025, or whenever a renovation is pursued, whether it touches electrical systems or not, whichever comes first. In addition, by this same time-frame, sub-meters of electrical consumption must be installed in all tenant spaces of 10,000 square feet or more and building owners need to provide tenants with monthly electricity consumption statements
